ANALYSIS OF THE LEGAL REQUIREMENTS TO OBTAIN THE GRANT OF IMPRISONMENT ALLOWANCE

This article aims to analyze the legal requirements for granting the prison allowance, a social security benefit intended for dependents of low-income insured individuals imprisoned under a closed regime. The research focused on normative and legal interpretation, using as main sources INSS/PRES Normative Instruction No. 128/2022, Decree No. 3,048/1999 (Social Security Regulations), Constitutional Amendment No. 103/2019 (Social Security Reform), and Law No. 8,213/91 (Provides for Social Security Benefit Plans and other measures). Analyzing the legal provisions, it became clear that granting the allowance depends on several factors: the inmate's insured status, proof of economic dependence of the beneficiaries, compliance with low-income requirements, and the condition of imprisonment under a regime determined by social security legislation. The study also addresses the tightening of legislative norms and the main challenges faced by applicants. In conclusion, although the benefit is an important social protection tool, its implementation requires rigorous documentary proof and compliance with specific and strict criteria, which can hinder access, especially for dependents of insured individuals in vulnerable situations.
